Right to Withdraw from Contract

1. [Deadline for withdrawal] A consumer who has concluded a distance or off-premises contract may withdraw from it within 14 days without giving any reason and without incurring costs.

2. [Time limit] The time limit for withdrawing from the contract begins:

1. for a contract in the performance of which the entrepreneur issues an item, being obliged to transfer its ownership from taking possession of the item by the consumer or a third party indicated by him other than the carrier
2. in the case of a contract that:

• a) includes many items that are delivered separately, in batches or in parts - from taking possession of the last item, batch or part,
• b) consists in regular delivery of items for a fixed period of time - from taking possession of the first item,
• c) for other contracts - from the date of conclusion of the contract.

3. [Form of withdrawal] The consumer may withdraw from the contract by submitting to the entrepreneur a statement of withdrawal from the contract, which is attached to these regulations. To meet the deadline, it is enough to send a statement before its expiry. If the entrepreneur provides the possibility of submitting a declaration of withdrawal from the contract electronically, the consumer may also withdraw from the contract using the model withdrawal form, constituting Annex 2 to the Act;

4. [Return of payment] The entrepreneur is obliged to immediately, not later than within 14 days from the date of receipt of the consumer's statement of withdrawal from the contract, return to the consumer all payments made by him, including the costs of delivering the item. The entrepreneur refunds the payment using the same method of payment as used by the consumer, unless the consumer has expressly agreed to a different method of return, which does not involve any costs for him. If the entrepreneur has not offered to collect the item from the consumer himself, he may withhold the reimbursement of payments received from the consumer until he receives the item back or the consumer provides proof of its return, depending on which event occurs first. If the consumer has chosen a delivery method other than the cheapest usual delivery method offered by the entrepreneur, the entrepreneur is not obliged to reimburse the consumer for the additional costs incurred by him.

5. [Limitations of the right to withdraw from the contract] The right to withdraw from a contract concluded off-premises or remotely is not entitled to the consumer in relation to contracts:

1. for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the performance of the service by the entrepreneur, he will lose the right to withdraw from the contract;
2. in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline to withdraw from the contract;
3. in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to meet his individual needs;
4. in which the subject of the service is an item that deteriorates quickly or has a short shelf life;
5. in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
6. in which the subject of the service are items which, due to their nature, are inseparably connected with other items after delivery;
7. concluded by way of a public auction;
8. on the basis of applicable regulations regarding veterinary conditions required for keeping, production, acquisition, maintenance, processing, storage, marketing or use of biological material, KI-GEN Sp. z o. o. does not accept returns of frozen bull semen.

6. In the event of exercising the right to withdraw from the contract, the consumer bears the direct costs of returning the Product. To the return shipment, please attach a statement of withdrawal from the contract (unless it has been previously delivered) and the account number to which the store is to return the payment.
